Terms of Service (EULA)

Welcome to Dubyspaces. By installing, accessing, or using the Dubyspaces mobile application ("App"), you agree to be bound by this End User License Agreement ("EULA"). If you do not agree, do not use the App.

1. Description of Service

Dubyspaces is a marketing platform connecting Businesses and Influencers. The App allows users to find businesses, complete "Missions", upload media content, and gain visibility.

2. User Generated Content (UGC) - Zero Tolerance Policy

Core Rule: Dubyspaces has a Zero Tolerance policy for objectionable content or abusive users.

You agree NOT to upload, post, or transmit content that is:

Illegal, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, or invasive of privacy.
Promoting racism, hatred, or violence against individuals or groups.
Infringing on patents, trademarks, trade secrets, copyrights, or other intellectual property rights.

Reporting and Blocking Mechanisms

To ensure community safety:

Reporting: Users can report inappropriate content via the "Report" button available on post or profile.
Blocking: Users can block abusive users to prevent future interactions.
Action Timeframe: Dubyspaces commits to reviewing all reports and removing objectionable content within 24 hours.
Removal and Ban: We reserve the right to remove content and eject users who violate these terms immediately and without prior notice.

3. "Business Pro" Subscriptions (Auto-Renewable)

Certain features are accessible via auto-renewable subscriptions ("Business Pro"). In compliance with Apple App Store policies:

Payment: Payment will be charged to your Apple ID Account at confirmation of purchase.
Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Renewal Cost: Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
Management: You can manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase.
Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4. Intellectual Property

The App and its original content (excluding content provided by users) are the property of Dubyspaces. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

6. Limitation of Liability

In no event shall Dubyspaces, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Disclaimer of Warranty

The App is provided "AS IS". Dubyspaces disclaims all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, Dubyspaces shall not be liable for any indirect, incidental, or consequential damages.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, excluding its conflicts of law rules. Your use of the Application may also be subject to other local, state, national, or international laws.
